On March 25, 2025, Menendez highlighted the importance of separation of powers in American democracy. He stated, "The separation of powers is the cornerstone of our democracy. Both Democratic and Republican AGs have challenged executive actions in court. This has become increasingly common during the era of Obama, Trump 1.0 and Biden."
In another tweet from the same day, he discussed the reactions to legal challenges against administrations. He remarked, "Democratic AGs have been successful in filing suits against the Trump Administration. So how do Trump and his Republican allies respond? They attack federal judges. Here’s why it’s not only problematic but also highlights their shameless hypocrisy."
Further clarifying his stance on bipartisan legal challenges, Menendez wrote on March 25, 2025: "To be clear, BOTH Dem and GOP AGs have taken administrations of the opposite party to court. That’s ok - see separation of powers point above. And don’t like a decision? You can appeal it."
